History

  • OPPER & GAMBRELL, P.L.L.C. was formed effective September 1, 2005.

Commercial Lending Services

  • The Firm's attorneys represent lender clients involving commercial loans, builder loans, master lines of credit loans, land development loans, working capital loans, small business loans, and non real estate secured loans.
  • Our attorneys are knowledgeable in the areas of federal and Texas business and consumer lending laws and regulations, homestead and title curative issues, federal and Texas law and regulations concerning these areas of lending. The Firm offers training for loan officers and other lending personnel, and memoranda on changes in the law and regulations to help our clients stay well informed.
  • The Firm also represents banks and thrifts in work-out negotiations, particularly on new construction. Our attorneys have comprehensive experience in settling mechanic's lien claims, bonding, title curative resolution and preparation of settlement agreements, for both residential and construction loan workouts.
  • When workouts are not feasible, the firm assists its lending clients in foreclosure of both personal property and real property collateral. We have the ability to economically post and foreclose in all counties in Texas.

Residential Lending Services

  • The Firm provides advice and representation to bank and thrift clients for consumer loans, including home improvement loans, interim construction loans, single close "one-time" construction/permanent loans, mini-perms, mortgage loans and home equity loans.
  • We provide advice to residential and commercial lending institutions regarding compliance with secondary marketing requirements of GNMA, FHLMC, and Fannie Mae, as well as state and federal laws and regulations, including HUD, VA, FHA, Federal Reserve Board, Office of Comptroller of Currency and Office of Thrift Supervision laws and regulations.
  • The Firm prepares full closing documentation (including Truth-in-Lending disclosures) for lenders originating residential loans, fully conforming to secondary market standards. As part of our document preparation, we review the survey and title commitment and advise the title company or the client of any irregular matters, or items which could affect sale into the secondary market.
  • We also offer document review services if our clients practice is to prepare its own documents in house.
  • We are able to provide special pre-closing and post-closing services, including review of closed loan packages, authorization to title companies to fund and shipment of packages to investors with receipt and verification of proper proceeds from investor to client.
  • The Firm develops loan packages and forms to implement specialized mortgage loan programs, including "one-time" closings, special ARM programs, early written disclosures required by The Banking Equality Act, Regulation Z, and initial and final Truth-in-Lending disclosures.
  • The Firm provides advice regarding all regulatory matters to help clients comply with RESPA, ECOA, HMDA, CRA and Fair Lending.
